Implementation of recommendations of the Law Commissions
Under clause 1(1)(a) it will be possible to reform legislation. Examples of the ways in which this order making power can be used are as follows:
Under clause 1(1)(b)
Law Commission
recommendations
can be
implemented, including those that amend common law
(clause 2(3)).
Usually, these recommendations
can only be enacted by primary legislation, for which Parliamentary time is at a
premium.
KuK>>> I believe this legislation can be used to implement Sharia Law without a debate in the House of Commons or the Lords. There is a Tax Law Commission that could recommend that polygamy be accommodated for the purposes of inheritance tax allowing the deceased husband's estate to be divided between all wives, reducing the burden of inheritance tax. I/we have seen news of the IR being approached by the Muslim community to request this. The highlighted sentence above indicates that Common law & legislative law can be amended........ This could mean that polygamous wives could be recognised in law..... Sharia Law could be incorporated into the British legal system by ministerial diktat if recommended by any Law commission.
